Pattr Terms of Service

These Terms of Service (“Terms”) are a contract between you and Pattr Co. They govern your use of Pattr’s sites, services, mobile apps, products, and content (“Services”).

​

By using Pattr, you agree to these Terms. If you don’t agree to any of the Terms, you can’t use Pattr.

​

We can change these Terms at any time. We keep a historical record of all changes to our Terms. If a change is material, we’ll let you know before it takes effect. By using Pattr on or after that effective date, you agree to the new Terms. If you don’t agree to them, you should delete your account before they take effect, otherwise your use of the site and content will be subject to the new Terms.

 

In consideration for Pattr granting you access to and use of the Services, you agree that Pattr may enable advertising on the Services.

 

Our content and services

We reserve all rights in Pattr's look and feel. Some parts of Pattr may be licensed under third-party open source licenses. We also may make some of our own code available under open source licenses. As for other parts of Pattr , you may not copy or adapt any portion of our code or visual design elements (including logos) without express written permission from Pattr unless otherwise permitted by law.

You may not do, or try to do, the following: (1) access or tamper with non-public areas of the Services, our computer systems, or the systems of our technical providers; (2) access or search the Services by any means other than the currently available, user interfaces that we provide; (3) forge any TCP/IP packet header or any part of the header information in any email or posting, or in any way use the Services to send altered, deceptive, or false source-identifying information; or (4) interfere with, or disrupt, the access of any user, host, or network, including sending a virus, overloading, flooding, spamming, mail-bombing the Services, or by scripting the creation of accounts in such a manner as to interfere with or create an undue burden on the Services.

Pattr is for your personal use. You may not display, distribute, license, perform, publish, reproduce, duplicate, copy, create derivative works from, modify, sell, resell, exploit, transfer or transmit for any commercial purposes, any portion of the Services, use of the Services, or access to the Services.

Crawling the Services is allowed if done in accordance with the provisions of our robots.txt file, but scraping the Services is prohibited.

​

We may change, terminate, or restrict access to any aspect of the service, at any time, without notice.

​

No children

​

Pattr is only for people 13 years old and over. By using Pattr, you affirm that you are over 13. If we learn someone under 13 is using Pattr, we’ll terminate their account.

​

Unacceptable behavior

​

You may not user Pattr to engage in abusive, hateful, or bullying behavior.

​

You may not user Pattr to facilitate, plan, or engage in illegal activity.

​

You may not record any conversation taking place on Pattr.

​

Determination of unacceptable behavior is in the sole discretion of Pattr Co.

​

Usernames

 

Pattr usernames are claimed on a first-come, first-served basis. A username can only be attached to one account at a time.

We encourage you to remain active with your Pattr account. Account usernames may be reclaimed after 6 months of inactivity.

 

You are encouraged to use your real name on Pattr.  We do not allow deceptive names or usernames, which includes using a name or username that impersonates a real person in a way that's likely to deceive.  When we find instances of this, we reserve the right to suspend or terminate the account.

Incorporated rules and policies

By using the Services, you agree to let Pattr collect and use information as detailed in our Privacy Policy. If you’re outside the United States, you consent to letting Pattr transfer, store, and process your information (including your personal information and content) in and out of the United States.

Termination

​

Pattr Co. may, in its sole discretion and without prior notice, suspend or terminate your account or use of the Services and remove and destroy any content within the Services, for any reason, including, without limitation, if Pattr Co. believes that you have violated or acted inconsistently with the letter or spirit of these Terms.

Miscellaneous

 

Disclaimer of warranty. Pattr Co. offers the Services as-is. To the fullest extent permitted by applicable law, Pattr Co. makes no representations or warranties of any kind concerning the Services, express, implied, statutory, or otherwise, including without limitation, warranties of title, merchantability, fitness for a particular purpose, or non-infringement. Pattr Co. does not warrant that the Services will be uninterrupted or error-free, that any content made available on or through the services will be error-free, that defects will be corrected, or that any servers used by the Services are free of viruses or other harmful components.

Limitation of Liability. To the fullest extent permitted by applicable law, in no event will Pattr Co. be liable to your on any legal theory for any incidental, direct, indirect, punitive, actual, consequential, special, exemplary, or other damages, including without limitation, loss of revenue or income, lost profits, pain and suffering, emotional distress, cost of substitute good or services, or similar damages suffered or incurred by your or any third party that arise in connection with the Services, or the termination thereof for any reason, even if Pattr Co. has been advised of the possibility of such damages.
 

Certain jurisdictions do not permit the exclusion of certain warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply to you. In these jurisdictions, the foregoing exclusions and limitations will be enforced to the greatest extent permitted by applicable law.
 

No waiver. If Pattr doesn’t exercise a particular right under these Terms, that doesn’t waive it.

Severability. If any provision of these terms is found invalid by a court of competent jurisdiction, you agree that the court should try to give effect to the parties’ intentions as reflected in the provision and that other provisions of the Terms will remain in full effect.

​

Choice of law and jurisdiction. These Terms are governed by New York State law, without reference to its conflict of laws provisions. You agree that any suit arising from the Services must take place in a court located in New York.

​

Entire agreement. These Terms (including any document incorporated by reference into them) are the whole agreement between Pattr Co. and you concerning the Services.
